Are you a small business owner? If so, you may qualify for an IRS tax credit of up to $5,000 to ensure your website is ADA compliant.

ADA compliance can earn you a tax credit and ensure a great user experience for everyone who visits your business website.

More importantly, it’s also a crucial step you can take to avoid becoming the target of a demand letter or lawsuit for not complying with the Americans with Disabilities Act (ADA).

What Does ADA Compliance Mean?

ADA compliance refers to a set of guidelines developed by an accessibility group within the World Wide Web Consortium (W3C), an international organization that sets standards for websites.

The guidelines outline the proper methods for incorporating accessible website features such as screen readers, keyboard navigation, fonts and colors, animations, content highlighting, and audio muting. When your website is ADA compliant, users of all abilities can navigate it and benefit from it.

Why You Shouldn’t Ignore ADA Compliance

If you think ADA compliance is an optional “nice-to-have” for your website, you may want to reconsider.

The Americans with Disabilities Act of 1990 is a civil rights law that prohibits discrimination based on an individual’s disability. This law applies to areas of public life (such as jobs, schools, and transportation) and private places that are open to the general public. Because your business website is available to the public, it needs to be accessible to people with disabilities.

If your website isn’t accessible, you run the risk of legal action being taken against your business. You may first receive a demand letter from an attorney requesting that you either pay restitution or take action to become compliant with the Americans With Disabilities Act. If you don’t respond to the demand letter, you could face a lawsuit.

If you receive a demand letter, you should take two steps immediately:

  • Consult an attorney.
  • Consult web developer experts such as WISE Digital Partners to begin updating your website for ADA compliance.

How Can I Get the Tax Credit?

Your small business qualifies if you had gross receipts of $1 million or less or fewer than 30 full-time employees in the preceding tax year.

You can receive 50 percent of eligible expenditures between $250 and $10,000 for the taxable year. The list of eligible expenses includes the cost associated with ensuring your website is ADA compliant.

If you’ve already completed the process of ADA compliance in the preceding tax year, or plan on doing so this year, check with your tax advisor to ensure your eligibility for the credit and further instructions.

Getting your website ADA compliant isn’t something to delay, for both your business and your target audience. Contact WISE Digital Partners to see how we can help!
